Acceptable Use Policy

This Acceptable Use Policy is part of our Terms of Service, currently accessible at https://genmo.ai/documents/terms_of_service.html. Capitalized terms used but not defined in this Acceptable Use Policy have the meanings given in our Terms of Service.

We strive to maintain a respectful environment for our users. You must not post, transmit, or make available any Inputs or Outputs through the Services, or otherwise use the Services, in any manner that could violate any Law or be objectionable to Genmo in its discretion.

Without limitation, we prohibit the following activities:

Interference

· Interfering with or disrupting Service operation, or violating or attempting to violate any requirements, procedures, policies, or regulations regarding the Services or any related hardware, software, or network.

· Making available through the Services any virus, worm, malware, Trojan horse, time/logic bomb, trap door/back door, spyware, or other materials that that could damage or hijack the operation of, or monitor the use of, any hardware, software, or network.

· Systematically downloading and/or storing Service content (including other users’ Inputs or Outputs), or using any robot, spider, site search/retrieval application, or other means to (a) retrieve, index, “scrape,” “mine,” or otherwise gather Service content, (b) reproduce or circumvent the Services’ navigational structure or presentation, or (c) create or compile a collection, compilation, database, or directory of content from the Services.

· Engaging in automated use of the Services, e.g., using scripts or bots to upload Inputs, send comments or messages, or generate Outputs.

· Hacking or defacing the Site.

Certain Materials and Uses

· Using the Services for any fraudulent, tortious, or unlawful purpose, including by directing the Services to generate Output that would or could violate any Law or contractual requirement.

· Posting, transmitting, or making available through the Services any Inputs, information, or materials, or using the Services to generate Outputs, in each case that are or may be:

o Defamatory, libelous, fraudulent, or tortious;

o Threatening, violent, hateful, intimidating, degrading, or disruptive, or that fail to respect the rights and dignity of others;

o Psychologically or emotionally harmful, including materials that may shame, humiliate, bully, harass, or promote self-harm;

o Obscene, indecent, lewd, or pornographic;

o Depicting child exploitation, abuse, or harm;

o Promoting, endorsing, encouraging, or facilitating the violation of any Law or contractual requirement or the dissemination of false information;

o Materials that act as passive or active information collection or transmission mechanisms, including clear GIFs, 1×1 pixels, web bugs, cookies, and similar devices; or

o Protected by copyright, trademark, trade secret, right of publicity or privacy, or any other proprietary right (e.g., a photograph of a person), in each case, without the express prior written consent of the applicable owner(s) thereof.

· Using the Services for purposes of political campaigning or lobbying, or to threaten or undermine democratic processes or institutions.

· Using Outputs in a misleading way (e.g., by representing that Outputs are entirely human-generated or that an Output depicts an actual photograph of a real event).

IP and Technological Matters

· Downloading, modifying, copying, distributing, transmitting, displaying, performing, publishing, or creating derivative works from, or licensing, selling, or offering to sell, all or any portion of the Services or any other Genmo proprietary technology made available or used through or in connection with the Services.

· Circumventing, altering, removing, deactivating, degrading, or interfering with any security measures, content protections, or other technological measures related to the Services or any Outputs (e.g., measures that prevent/restrict Service content copying or use, or that enforce Service usage limitations).

· Reverse engineering (except where such restriction is expressly prohibited by applicable Law), decompiling, or disassembling or decoding any Services or underlying technologies, or attempting the foregoing.

· Developing any interface to access the Services (e.g., an application programming interface (API)) without our prior written consent.

· Framing, mirroring, or replicating Services or incorporating them into any other product or service.

· Using the Services or any Outputs to develop other products, services, or technologies (including those that compete with Genmo or any Services), or attempting to extract or replicate models or other technologies used in connection with the Services.

· Removing or obscuring copyright, trademark, or other proprietary rights notices or watermarks from any Services or Outputs.

· Recreating any username or account that we have previously blocked or removed.

· Re-registering for or accessing or using the Services (e.g., under a different name) if we have previously blocked, suspended, or banned you from one or more Service(s).

Interactions With Users

· Restricting or inhibiting any other person from using the Services, or degrading or interfering with other users’ use of the Services.

· Harvesting or collecting Service user information; impersonating or misrepresenting your affiliation with any person or entity; or stating or implying that we or any Genmo Entity endorse your Inputs, Outputs, or statements.

· Engaging in “spamming,” “phishing,” or similar practices.

· Using the Services or any Output to disparage, tarnish, or harm the reputation of Genmo, any other Genmo Entity, or the Services.
